By using our services at Tint Bolt and S3 Tint (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services. Your use of our Services is also subject to our Privacy Policy, which covers how we collect, use, share, and store your personal information.

2. Description of Services

Tint Bolt provides a comprehensive business management platform for automotive window tinting businesses, including:

  • Booking and appointment management system
  • Customer relationship management (CRM)
  • Payment processing and invoicing
  • Inventory management
  • Analytics and reporting
  • Calendar and scheduling tools
  • Customer communication tools
  • Business analytics and insights

3. Account Registration and Management

To access our Services, you must create an account and provide accurate, current, and complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains accurate and up-to-date

6. Payment Terms

Our Services may include paid features and subscriptions. Payment terms include:

  • All fees are payable in advance and are non-refundable unless otherwise stated
  • We use Stripe for Tint Bolt subscription billing and Square for supported merchant payment features; the applicable processor receives the information needed to complete the transaction
  • You authorize us to charge your payment method for all fees
  • Prices may change with 30 days' notice
  • Failed payments may result in service suspension
  • Refunds are provided at our discretion and in accordance with our refund policy

7. Data and Privacy

Your use of our Services involves the collection and processing of data:

  • You are responsible for the accuracy of data you input
  • You must comply with applicable data protection laws
  • You must obtain consent from your customers for data collection
  • We process data in accordance with our Privacy Policy
  • You retain ownership of your customer data
  • We may use anonymized data to improve our services and create industry insights
  • By using our Services, you grant us permission to create aggregated, anonymized market reports

8. Third-Party Integrations

Our Services integrate with third-party services:

  • Stripe for Tint Bolt subscription billing
  • Square for supported merchant payment features
  • Google Analytics for usage analytics
  • Facebook Pixel for advertising tracking
  • Intercom for customer support
  • Firebase for data storage and hosting

These integrations are subject to the respective third-party terms of service and privacy policies.

9. Service Availability

We strive to provide reliable service but cannot guarantee:

  • Uninterrupted or error-free service
  • Immediate resolution of all issues
  • Compatibility with all devices or browsers
  • Availability during maintenance periods

We will provide reasonable notice of scheduled maintenance and work to minimize service disruptions.

10. Intellectual Property

All content included in our Services, such as text, graphics, logos, images, and software, is the property of Tint Bolt or its content suppliers and protected by international copyright laws. The compilation of all content on the Services is the exclusive property of Tint Bolt and protected by international copyright laws.

You retain ownership of your content and data, but grant us a license to use it to provide our Services.

11. User Content

You are responsible for all content you upload, create, or share through our Services:

  • You must have the right to use and share such content
  • Content must not violate any laws or rights of others
  • We may remove content that violates these Terms
  • You grant us a license to use your content to provide our Services

12. Warranty Disclaimers

To the fullest extent permitted by law, Tint Bolt and its affiliates, suppliers, and distributors make no warranties, either express or implied, about the services. The services are provided "as is." We also disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, in no event will Tint Bolt, its affiliates, suppliers, or distributors be liable for any indirect, special, incidental, punitive, exemplary or consequential damages or any loss of use, data, business, or profits, regardless of legal theory, whether or not Tint Bolt has been warned of the possibility of such damages, and even if a remedy fails of its essential purpose.

14. Indemnification

You agree to indemnify and hold harmless Tint Bolt, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or share

15. Termination

Either party may terminate these Terms at any time:

  • You may cancel your account at any time
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your access to the Services will cease
  • We may retain your data for a reasonable period as required by law
  • Certain provisions survive termination (e.g., intellectual property, liability limitations)

16. Data Export and Portability

Upon request, we will provide you with a copy of your data in a standard format. You are responsible for:

  • Exporting your data before account termination
  • Ensuring you have backups of important information
  • Complying with data retention requirements for your business

17. Changes to the Terms

We may revise these Terms from time to time, and will always post the most current version on our website. By continuing to use or access the Services after the revisions come into effect, you agree to be bound by the revised Terms. We will provide notice of material changes via email or in-app notifications.

17.1 Retroactive Application

These Terms apply to all use of our Services, including data and activities that occurred before the effective date of these Terms. By continuing to use our Services after the effective date, you acknowledge and agree to these Terms, including our right to use historical data for market insights and industry analytics as described in our Privacy Policy.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Canada without regard to conflict of law principles. You and Tint Bolt agree to submit to the personal jurisdiction of a provincial court located in Calgary, Alberta, Canada for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction.

19. Dispute Resolution

Before pursuing formal legal action, we encourage you to contact us directly to resolve any disputes. If a dispute cannot be resolved informally, it will be resolved through binding arbitration in accordance with the laws of Alberta, Canada.

20. Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, natural disasters, power outages, or government actions.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

22. Entire Agreement

These Terms constitute the entire agreement between you and Tint Bolt with respect to the subject matter of these Terms and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms.
